Is corporate tax mandatory for all businesses in the UAE?
Yes. UAE Corporate Tax at 9% applies to all juridical persons incorporated in the UAE and foreign entities with a UAE permanent establishment, effective for financial years starting on or after 1 June 2023. All entities must register with the FTA regardless of whether they have taxable income.
What is the UAE corporate tax rate?
The UAE corporate tax rate is 0% on taxable income up to AED 375,000 and 9% on taxable income exceeding AED 375,000. Qualifying Free Zone Persons (QFZPs) may be eligible for a 0% rate on qualifying income, subject to meeting substance and other conditions under Federal Decree-Law No. 47 of 2022.
When is the UAE corporate tax return filing deadline?
UAE corporate tax returns must be filed with the FTA within 9 months from the end of the relevant tax period. For businesses with a 31 December year-end, the filing and payment deadline is 30 September of the following year.
Do free zone companies pay corporate tax in the UAE?
Free zone companies may qualify for a 0% corporate tax rate on qualifying income if they meet Qualifying Free Zone Person (QFZP) conditions, including maintaining adequate economic substance. They must still register with the FTA and file annual returns.
What is transfer pricing in the context of UAE corporate tax?
Transfer pricing rules under UAE corporate tax law require that transactions between related parties are conducted at arm's length. UAE businesses with significant related-party transactions must maintain transfer pricing documentation to support the pricing of those transactions.
